WEB HOSTING SERVICES AGREEMENT

  • BITS shall use its reasonable endeavours to make the server and the Services available to the Customer 100% of the time. BITS however makes no warranties or representations that the Service will be uninterrupted or error-free and BITS shall not, in any event, be liable for interruptions of Service or downtime of the server.
  • For clients with dedicated hosting:
    • If/When an outage occurs it will be detected by our monitoring software. This facility pings the URL at regular intervals, reports back server response times and flags performance issues. In the event of a website outage, we will provide the necessary support to resolve the issue. However, there is an understanding on behalf of the Client that the hosting service does not include website design support and/or updates to your site (these are services that can be provided separately if required). If an issue occurs where all Hosting Services and Resources are confirmed to be operating as normal through our Data Centre and the fault lies directly with your site, BITS reserves the right to take your site off-line and to work with you to help resolve the issue. In the event where the issue cannot be resolved and a full backup is required, BITS will carry out that restore for the client. However in the event where a backup will not resolve the issue or a recurring fault occurs, BITS reserve the right to take your site off-line until the issue is completely resolved (likely through a redesign provided by BITS or a 3rd party designer selected by the Client). If the version of the technology/platform is out-of-date and any such support requested by the Client in relation to this, the client will be billed for at the current Hosted Services Rate. However once your website remains up-to-date for the platform it is built on, then we will provide all necessary support. The resources hosted on our dedicated Virtualised Servers will be automatically backed up daily.
    • Business IT Solutions does not set specific limits on their web hosting services (in terms of bandwidth) outside of the specified Virtualised Server specifications. However, we reserve the right to review every account for excessive space and bandwidth utilisation and may terminate, apply restrictions or additional fees to those accounts with excessive usage levels.
  • For clients on our standard multi-tenancy hosting:
    • There is an understanding on behalf of the Client that the hosting service does not include website design support and/or updates to your site (these are services that can be provided separately if required). In the event that the issue cannot be quickly resolved or a recurring fault occurs, BITS reserve the right to take your site off-line until the issue is completely resolved (likely through a redesign provided by BITS or a 3rd party designer selected by the Client).
    • Sites are subject to diskspace limits: no site may exceed 2GB in size. We reserve the right to review every account for excessive space and bandwidth utilization. In the event that limits are breached, we will issue recommendations on how best to address the issue by reducing usage or upgrading hosting plan. In the event that limitation breaches are not addressed by client, we may terminate, apply restrictions or additional fees to those accounts with excessive usage levels.
  • For clients availing of custom multi-tenancy hosting:
    • there is an understanding on behalf of the Client that the hosting service does not include website design support and/or updates to your site (these are services that can be provided separately if required). The Web Hosting Services Agreement may include a provision for website backups. In the event of website downtime and a full backup is required, BITS will carry out that restore for the client. In the event where a backup will not resolve the issue or a recurring fault occurs, BITS reserve the right to take your site off-line until the issue is completely resolved.
    • Sites are subject to diskspace limits. These are dependent upon individual Web Hosting Service Agreements. We reserve the right to review every account for excessive space and bandwidth utilization. In the event that limits are breached, we will issue recommendations on how best to address the issue by reducing usage or upgrading hosting plan. We reserve the right to review every account for excessive space and bandwidth utilisation and may terminate, apply restrictions or additional fees to those accounts with excessive usage levels.
  • By entering into this Contract you agree to the details as laid out. You further agree to any revisions of these policies as they occur. Changes to these policies will be posted on our website.
  • Unless otherwise stated, the minimum Term of the Agreement will be 1 Year from the start of Services.
  • The initial fees are due immediately at the time of ordering and are non-refundable unless otherwise expressly noted.
  • Backup of hosted resources will automatically take place for sites on our dedicated servers, as well as those sites on custom multi-tenancy hosting facilities. However, if you (or any 3rd party) require a restoration of data backed up, there will be a fixed fee charge of €100.
  • All prices quoted within this document are subject to change and exclude VAT.

AUTO-RENEWAL OF WEB HOSTING SERVICES AGREEMENT:

Web Hosting Services Agreement will be automatically renewed at BITS then-current rates, unless noted otherwise. Notice of increase in rates will be provided within issued invoices.

The Web Hosting Services Agreement can be terminated by the client if they place a service termination request at least 1 month before the service renewal date. The termination request can only be accepted in writing (email) and must be from the authorised account holder and sent to accounts@bits.ie.

TERMINATION OF SERVICES:

BITS may immediately terminate any account, without prior notice, for non-payment or any account that it believes, in its sole discretion, is involved in any objectionable activities as deemed inappropriate by BITS.

In order to maintain the integrity of the hosting environment, BITS may immediately suspend the hosting of any resources that have become compromised or are the target of sustained denial-of-service (DOS) attack.

A written request to cancel the service (as mentioned above) does not release the client from any contractual obligations that are in force at the time of the cancellation and will serve as notice not to renew the domain or hosting service for the next contractual period (12 months). As above, BITS require this request to be placed at least 1 month before the service renewal date. The termination request can only be accepted in writing (email) and must be from the authorised account holder and sent to accounts@bits.ie.
